    Ms. Jiang's main practice areas are customs matters, including trade compliance consulting, administrative enforcement and investigation, and criminal defense. She is experienced in assisting clients in customs enforcement. Ms. Jiang has provided accurate legal advice to many multinational corporations and State-owned enterprise on difficult issues related to import and export business, sorted out the compliance risks of import and export business, and solved practical problems in import and export business; represented the Chinese entities of many multinational corporations to deal with the administrative law enforcement of customs inspections on complex tax-related matters such as categorization, royalties, transfer pricing, etc.; and provided criminal counseling and criminal defense services to import and export enterprises suspected of smuggling and their executives.

  • Professional History

    Before joining Haiwen & Partners, Ms. Jiang was a consultant of a leading Chinese law firm, heading its customs practice. Ms. Jiang has extensive experience in customs enforcement. She has worked in the anti-smuggling department of the Customs for a long time and was mainly responsible for handling customs administrative penalties and smuggling crimes cases. she has also served as a Customs Public Attorney, and has represented the Customs in administrative litigation and administrative reconsideration for many times.

    Represented a diamond import and export enterprise in a case of suspected smuggling goods, and ultimately obtained the result of not prosecuting the whole case.

    Represented a private organization in a case of suspected smuggling of general cargo, resulting in no prosecution of the entire case.

    Represented a Zhejiang-based jewelry company and its controllers in a case of suspected smuggling of goods, and ultimately obtained the result of not prosecuting the whole case.

    Represented a U.S. healthcare product manufacturer in connection with criminal enforcement of suspected domestic resale of cross-border e-commerce goods, ultimately preventing the company from being held criminally liable.

    Represented one of the world's largest manufacturers of popular skin care products in a criminal investigation of its joint venture subsidiary in China by a subordinate Customs anti-smuggling bureau, where the procuratorate has decided not to authorize the arrest of the employees involved in the case.

    Represent a world-leading material company in responding to Chinese customs audits and anti-smuggling enforcement, assisting the client in resolving disputes with customs regarding the classification of goods.

    Represent a cosmetics cross-border e-commerce company in responding to criminal enforcement faced by the company for alleged in-country resale; ultimately enable the company to avoid criminal liability.

    Represent a European lighting company in a dispute over the classification of imported goods; successfully persuade Customs to accept the client's opinion on the classification of the goods in question.

    Represent a leading Japanese rubber company in legal and compliance issues related to its business model for exporting goods to China, focusing on the potential tariff impacting on the company's exports after the Regional Comprehensive Economic Partnership (RCEP) came into force, and providing detailed planning on customs clearance process practices.

    Provide legal advisory services to a U.S. company suspected of cross-border e-commerce import declaration irregularities, assist the company in sorting out the risk exposure of import and export business processes, and provide advice on import and export compliance.

    Ms. Jiang has participated in the revision of the Customs Law, the Provisions of the Customs of the People's Republic of China on the Procedures for Handing Administrative Penalty Cases,the Measures of the Customs of the People's Republic of China for Hearings on Customs Administrative Punishments,and co-authored the “Handbook of Compliance Management System - Principles, Elements and Practical In 2023,  published by Law Press.

    Ms. Jiang received her MPA degree from the University of International Business and Economics and a Bachelor of Laws degree from the China Youth College of Politics.
