    Ms. Jia is a Partner of Haiwen & Partners. Ms. Jia has a Ph.D. degree in physics from University of North Carolina-Chapel Hill in U.S.  She is registered before the Chinese Patent Office and is licensed to practice law in both China and the State of California in U.S. She is experienced in handling IP litigations and cross boarder IP transactions.

    Ms. Jia joined Haiwen in April 2022 as partner.  Before joining Haiwen, she worked at Zhonglun Law Firm from 2013 to 2022, and worked at a top patent agency from 2008 to 2013.

  • Experience highlights

    ■ Represented Sogou in 28 patent invalidation, administrative litigation and infringement lawsuits against Baidu, involving computer science, internet and smart terminals, etc. The series of cases were called “China's No. 1 Internet Patent Cases”, were selected as Deals of the Year by Business Law Journal in 2019 and 2020, and one of the cases was selected by the Supreme Court of China as an exemplary case in intellectual property area

     Represented Taiwan Semiconductor Manufacturing Company, Ltd. (TSMC) in responding to a patent infringement war in the semiconductor field initiated by Global Foundries, involving semiconductor design processes and devices, and successfully assist the client to reach a global settlement

    ■ Represented Jiangsu Changdian, a tier one semiconductor packaging enterprise in China, in a series of IP cases against Yongxi, including patent invalidation, patent ownership disputes, unfair competition disputes, etc.  

    ■ Represented a U.S. public company NETGEAR in responding to more than 20 patent infringement lawsuits filed by a well-known NPE iPEL before multiple courts, 4 administrative enforcement cases before multiple local patent offices, and the parallel patent invalidation cases before the Patent Office, involving wireless network storage, wireless router products and telecommunication technologies

    ■ Represented Sony in a standard essential patent infringement litigation initiated by IWNCOMM before Beijing Intellectual Property Court, and the parallel patent invalidation case before the Patent Reexamination Board, involving mobile phone technology, and WAPI standard essential patent

    ■ Represented Kautex, a global tier one auto parts manufacturer headquartered in Germany, in a series of patent infringement litigation, patent administrative litigation and patent invalidation cases, as well as IP licensing, involving auto parts and mechanical structure

    ■ Represented Organic Waste Systems NV, a Belgian waste disposal company, in a series of patent infringement lawsuits against multiple infringers in the Zhengzhou Intermediate People’s Court, involving environmental protection, green energy technology, and government projects

    ■ Represented Verily, a life science company under Google, in a patent litigation, involving medical electronic devices

    ■ Represented 720 Degrees to sue Nintendo for patent infringement, involving Nintendo's Switch and finally helped the client reach a global settlement

    ■ Represented Kudelski Group, NagraVision and Open TV in a series of patent infringement litigations against Apple involving digital security, smart phone technology before Beijing Intellectual Property Court

    ■ Represented Hengbao Co. Ltd. in a patent infringement case before Beijing High Court against Watchdata Technologies, involving physical authentication methods for making online payments

    ■ Represented Schott, a world-renowned special glass supplier, in preparation of patent infringement and copyright infringement disputes, and IP licensing and negotiations with its suppliers and downstream clients, etc., involving cell phone cover glass manufacturing processes and materials.

    ■ Represented BASF, a global petrochemical giant, in conducting pre-litigation work such as patent infringement investigations, and prepared to file a patent infringement case involving surface treatment agent technology.

    ■ Represented ExxonMobil, a global petrochemical giant, in potential patent infringement disputes, involving chemical materials and preparation process.

    ■ Represented Qualcomm in preparing for a standard-essential patent litigation, involving frequency-hopping spread spectrum.

    ■ Represented Tencent in a series of patent invalidation cases, involving online payment, identity verification, online certificate authentication, etc.

    ■ Represent RealNetworks in a software copyright infringement dispute involving audio/video encoding and decoding technique in mobile phones and computers

    ■ Represented ENZE fund, the first fund under SINOPEC, in multiple M&A projects, conducted due diligence against target companies on the legal status, ownership, assignment and licensing status of the intellectual property, evaluated the patent stability and risk of patent infringement, etc., involving the fields of novel material and new energy

    ■ Represented Huawei to conduct research and analysis on intellectual property related legal issues in the AI field, and issued analysis reports including intellectual property protection strategies, intellectual property agreement drafting, AI legal risks in specific industries, etc.

    ■ Represented Aerospace Research Institute in a research program regarding IP protections in the trade shows in China, U.S., Germany and Russia, and provide legal advice on the preparation before attending the trade show

    ■ Represented Tencent in an investment project, conducted due diligence against the target company on the legal status, ownership, assignment and licensing status of the intellectual property, draft the technology licensing agreement and reseller agreement, and negotiate with the other parties, involving computer games and internet service

    ■ Represented China Resources Pharmaceutical Group in a cross border IP import, cooperated with attorneys in other jurisdictions to perform due diligence on the legal status, ownership, assignment and licensing status of intellectual property of the target company, conducted compliance investigation on drugs and clinical trial data, involving treatment technology of certain chronic disease

    ■ Represented Sequoia Capital in an investment project, performed due diligence on the legal status, ownership, transfer and licensing status of intellectual property of the target company, conducted investigation on the core technical staff and sources of technology, and evaluated risk of patent infringement, involving telecommunications technology

    ■ Represented Ant Technology Group Co., Ltd. in evaluating the stability of a series of patents involving computer technology

    ■ Provide training courses for Siemens Energy, including hot issues in the fields of patent, trade secret, copyright and trademark

    ■ Represented a U.S. company Hyperice for dealing with patent infringement complaints filed at e-commerce platform by its competitor, and successfully reached a settlement and follow-up cooperation with the competitor, involving massage gun technology

    ■ Represented British Telecom in negotiating on standard essential patent licenses, involving wireless communication technology

    ■ Represented NAGRA, a European group company, in patent portfolio licensing and transfer matters, involving more than 500 global patents, involving electronic payment cards, NFC, etc.

    ■ Advised Cognex, a global visual industry supplier, in a potential software infringement matter

    ■ Represented China National Nuclear Corporation to form a joint venture with a domestic university in China, performed due diligence on the legal status, ownership, assignment and licensing status of intellectual property of the target company, conducted investigation on the core technical staffs and sources of technology, and evaluated risk of patent infringement and compliance, and negotiated with the university on IP licensing and assignment, involving new energy

    ■ Represented China National Nuclear Corporation in technology import from the United States and Singapore and took part in licensing negotiations, involving the field of solar cells

    ■ Represented Shaanxi Wright Optoelectronics, a domestic OLED material giant, in patent stability and non-infringement analysis and patent license negotiations, and successfully assisted the client to secure a patent license from a foreign company, involving organic compounds and manufacturing processes in the OLED field

  • Education

    Ms. Jia received her B.S. in physics from Jilin University in 2001, and Ph.D. in Physics from University of North Carolina at Chapel Hill in U.S. in 2007, and worked as a postdoc in the medical school of University of Pittsburgh from 2007-2008.
